Limitation of Liability
Limitation of Liability
Plain-English notice: Limitation language can depend on state, country, transaction type, and customer type. Have this reviewed by qualified legal counsel before relying on it commercially.
Self-hosted responsibility
SmithShop is self-hosted ecommerce software. The customer is responsible for hosting, server security, file permissions, PHP/MySQL configuration, SSL, backups, credentials, admin passwords, DNS, email deliverability, payment account setup, tax rules, shipping rules, product claims, privacy compliance, and launch testing.
No indirect damages
To the fullest extent allowed by law, SmithShop is not responsible for indirect, incidental, special, consequential, exemplary, or punitive damages. This includes lost profits, lost sales, lost data, lost rankings, lost advertising spend, lost goodwill, business interruption, downtime, chargebacks, carrier mistakes, payment processor issues, tax mistakes, or third-party account problems.
Liability cap
To the fullest extent allowed by law, SmithShop's total liability for any claim related to the software, add-ons, support, updates, restore tools, documentation, or website is limited to the amount the customer paid to SmithShop for the affected software or add-on during the period allowed by applicable law.
Third-party failures
SmithShop is not responsible for outages, policy decisions, billing disputes, account suspensions, API changes, security incidents, service limits, or incorrect results from third-party services such as payment processors, shipping carriers, tax providers, Google services, Mailchimp, ShipStation, Freightview, WARP, AI providers, hosting companies, DNS providers, or email providers.
Testing before launch
Customers should test product setup, checkout, payment, shipping, tax, email, downloads, updates, restore, and admin workflows before accepting real customer orders. A store should not be treated as production-ready until the owner has tested its actual configuration.
